It seems in our legal tradition the burden is on those who want to restrict any behavior. Restricting, controlling the behavior of others, imposing penalties for "offending" needs to be justified on some grounds or others, especially in a land of "freedom" for "life, liberty, and the pursuit of happiness". All action is permitted, unless denied, and denial should be for articulated and public reasons, nez pas?

So have at it. convince me, but if you can't, then go away, like you will (that's facetious not prescriptive).
